We collect your Personal Information for the primary purpose of providing our services to you, providing information to our clients and marketing. We may also use your Personal Information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure. You may unsubscribe from our mailing/marketing lists at any time by contacting us in writing.

When we collect Personal Information we will, where appropriate and where possible, explain to you why we are collecting the information and how we plan to use it.

Scope of this Policy

This Privacy Statement applies to all our services including our website, app, and other products as referenced on On Me Group. It covers how personal information is collected, used, and shared.

See On Me is intended for use by individuals aged 16 and over. By creating an account and uploading a photo, you confirm that you are at least 16 years old.

Sensitive Information

Sensitive information is defined in the Privacy Act to include information or opinion about such things as an individual's racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record or health information.

Sensitive information will be used by us only:

For the primary purpose for which it was obtained
For a secondary purpose that is directly related to the primary purpose
With your consent; or where required or authorised by law.

If you use our virtual try-on feature, the full-body photo you upload is sent to our image-generation partner, FASHN.AI, solely to generate an image showing you in the retailer's product. We use FASHN.AI's privacy-focused delivery method: your photo does not appear in FASHN.AI's stored request records, and the resulting try-on image is available for up to 60 minutes after generation before it expires from their systems. FASHN.AI does not use your photo to train or fine-tune its models. These retention practices are set by FASHN.AI and may change; the current version of their policy is available at docs.fashn.ai/api-overview/data-retention-privacy. You can delete your photo from our systems at any time by deleting your account.

Third Parties

Where reasonable and practicable to do so, we will collect your Personal Information only from you. However, in some circumstances we may be provided with information by third parties. In such a case we will take reasonable steps to ensure that you are made aware of the information provided to us by the third party.

Disclosure of Personal Information

Your Personal Information may be shared in a number of circumstances including the following: with our service providers and business partners (e.g., to offer products or services), including, without limitation, third party hosting providers (such as Vercel) and other vendors and service providers such as Supabase (database), FASHN.AI (image generation), Resend (transactional email), Google Analytics (website and product analytics), and Sentry (error and performance monitoring), to help us to provide you with the Website and Platform services. We allow our customers to share some content/information with its third-party integrations. Please note that these actions are being done by the customer itself and subject to their request.

To the extent necessary, with regulators, courts or competent authorities, to comply with applicable laws, regulations and rules (including, without limitation, federal, state or local laws), and requests of law enforcement, regulatory and other governmental agencies or if required to do so by court order.

Security of Personal Information

Your Personal Information is stored in a manner that reasonably protects it from misuse and loss and from unauthorised access, modification or disclosure. In the event of a data breach, we will notify affected users promptly so they can take protective measures. Where required under the GDPR, we will also notify the relevant supervisory authority without undue delay, and within 72 hours of becoming aware of the breach where feasible.

We retain your Personal Information for as long as your account remains active. If you delete your account, your profile information and photo are deleted at that time. Some data, such as system logs and analytics records, may be retained for a shorter period in line with our service providers' standard settings, for operational and security purposes.

Access to your Personal Information

You may access the Personal Information we hold about you and to update and/or correct it, subject to certain exceptions. If you wish to access your Personal Information, please contact us in writing.

On Me Group will not charge a fee for your access request or for providing the first copy of the Personal Information we hold about you. If a request is manifestly unfounded, excessive, or repetitive, we may charge a reasonable administrative fee, or decline to act on the request. In order to protect your Personal Information we may require identification from you before releasing the requested information.

Region-Specific Rights:

EEA, UK, and Swiss Users: Depending on your location, you may have rights under the GDPR including the right to access, rectify, or erase your Personal Information; the right to restrict or object to our processing of it; the right to data portability; the right to withdraw consent at any time (without affecting the lawfulness of processing carried out before that withdrawal); and the right to lodge a complaint with a supervisory authority.
California Users: Rights under the CCPA include opting out of the sale of personal information and additional disclosures about personal information collected.

Where the GDPR applies, we process your Personal Information on the following bases: your name, email, and password are processed under contract, as necessary to provide our services to you; your full-body photo is processed under contract for each individual try-on session, and under consent where stored persistently on your profile; your gender and body measurements, where provided, are processed under consent; and usage and product analytics are processed under our legitimate interests in understanding and improving our services.

Maintaining the Quality of your Personal Information

It is an important to us that your Personal Information is up to date. We will take reasonable steps to make sure that your Personal Information is accurate, complete and up-to-date. If you find that the information we have is not up to date or is inaccurate, please advise us as soon as practicable so we can update our records and ensure we can continue to provide quality services to you.

Policy Updates

This Privacy Policy can be updated from time to time and, therefore, we ask you to check back periodically for the latest version of this Privacy Policy. If we implement significant changes to the use of your Personal Data in a manner different from that stated at the time of collection, we will notify you by posting a notice on our Website and/or Platform or by other means.
